The impetus for this paper was an unexpected downturn in the New Mexico Department of Corrections (NMCD) prison population. The total inmate population on June 30, 2006 reached a high of 6,803 and by May 2008 the population had dipped to 6,361. This represents a 6.6% drop in the prison population over a two year period. We drafted this paper to assist the LFC and the NMCD in their understanding of the possible reasons for the downturn in the prison population. | Description: | Authority over sentencing length is divided among legislators, prosecutors, judges, parole boards, sentencing commissions (in some jurisdictions), and correction officials. With regard to the latter, their power to award "good time" credits may reduce a sentence by a quarter, a third, a half, or more. Thus, it is possible to devise a sentencing system in which corrections officials have more impact on the time actually served by offenders than even sentencing judges. By the same token, it is also possible to curtail that impact by restricting the amount of good time credits under the control of prison authorities. |
